Who We Are

We are Elevétion LLC, a Utah limited liability company, with a principal office location located at Draper, UT 84020, and its affiliates and subsidiaries (“Elevétion,” “we,” “our,” “us”). References to any of our affiliates means any entity that directly or indirectly controls us, is controlled by us, or is under our common control.

 

Introduction

These terms and conditions (together with the documents referred to in them) (the “Terms of Service”) govern your access to and use of any of our websites that reference these Terms of Service, including those located at www.elevetion.com (collectively, the “Website”), including any content, functionality, and services offered on or through the Website.

Please read these Terms of Service carefully before you start to use the Website. By using the Website or by clicking to accept or agree to these Terms of Service when this option is made available to you, you will be deemed to have understood and accepted these Terms of Service.

These Terms of Service form a binding agreement between you and us. If you do not agree to these Terms of Service, you must not access or use the Website. The Terms of Service should be read in conjunction with our Privacy Policy.

IMPORTANT INFORMATION ABOUT DISPUTE RESOLUTION: These Terms of Service provide that all disputes between you and Elevétion in connection with the Website will be resolved by BINDING ARBITRATION, to the fullest extent permitted under applicable law. YOU AGREE TO GIVE UP YOUR RIGHT TO GO TO COURT to assert or defend your rights under these Terms of Service, except for matters that may be taken to small claims court. Please review the Arbitration and Governing Law sections for details. 

The Website, products, and services are offered to users who are 18 years of age or older and reside in jurisdictions where access is lawful. By using the Website, you represent that you meet these eligibility requirements and agree to be bound by these Terms of Service.

Changes to These Terms of Service

At any time, to the extent permitted by applicable law, we may amend these Terms of Service to ensure compliance with relevant laws and regulations, to improve your experience using the Website, or as otherwise determined by us. All changes are effective immediately upon posting and apply to all subsequent use of the Website.

Please check this page frequently to take notice of any changes we have made. Your continued use of the Website after changes are posted means that you accept and agree to be bound by the changed Terms of Service.

 

The Website

General

We offer the Website for several purposes, including providing information about health and wellness topics, Elevétion products and services, events, and other news. The purposes described are not exhaustive, and we may decide to offer additional or cease providing any Website functions at any time, in our sole discretion without notice. We may engage subcontractors to perform, provide, or support the performance or provision of all or any portion of the Website.

 

Replace with Scope of practice – Telehealth Services (U.S. Residents Only)

Elevétion does not provide medical services directly. If you reside in the United States, you may be eligible to access telehealth services through a telehealth platform (the “Telehealth Platform”) as part of the Elevétion Wellness Program that we sponsor. The Telehealth Platform is provided through the Refill.co provider network. Elevétion is not a healthcare provider and does not provide health care services to patients. Accessing the Telehealth Platform does not create a patient-provider relationship between you and Elevétion. With your authorization, your telehealth provider may share certain personal and health information with us for purposes described in your authorization form, our Privacy Policy, and our Consumer Health Data Policy. 

E-Commerce Services

You may be able to purchase products and services through the Website. YOU REPRESENT AND WARRANT THAT YOU HAVE THE LEGAL RIGHT TO USE ANY PAYMENT METHOD utilized in connection with any transaction. By submitting payment information, you grant to Elevétion the right to provide such information to third parties to facilitate the completion of transactions.

Elevétion reserves the right, with or without prior notice, to: (i) limit the available quantity of or discontinue any product or service; (ii) impose conditions on promotional codes; (iii) bar any user from making transactions; and (iv) refuse to provide any user with any product or service.

You agree to pay all charges incurred through the Website at the price(s) in effect when such charges are incurred, including all applicable shipping, handling, and taxes.

All sales are final with no refunds unless otherwise stated. Our e-commerce services are hosted by Shopify. Please refer to Shopify’s Consumer Privacy Policy for information about how they process your personal data.

 

Accessing the Website and Account Security

We reserve the right to withdraw or amend the Website, and any service or material provided on it, in our sole discretion without notice. We will not be liable if all or any part of the Website is unavailable at any time or for any period.

You are responsible for:

  •       Making all arrangements necessary to access the Website
  •       Ensuring that all persons accessing the Website through your internet connection comply with these Terms of Service
  •       Keeping your account credentials confidential and not disclosing them to others

You agree to notify us immediately at admin@elevation.com of any unauthorized access or security breach and to log out of your account after each session, especially on public or shared devices.

 

Intellectual Property Rights

The Website and its entire contents, features, and functionality (including but not limited to artwork, text, graphics, photos, logos, images, trademarks, audio and audio-visual clips, databases, and software) (collectively, the “Content”) are owned by us, our affiliates, our licensors, or other providers and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

These Terms permit you to use the Website and Content for personal, non-commercial purposes only. No commercial use of the Website or Content is allowed without our prior written consent. Unauthorized use of the Website or Content immediately terminates your rights under these Terms of Service.

You must not:

  •       Modify copies of any Content
  •       Delete or alter any copyright, trademark, or proprietary rights notices
  •       Reproduce, distribute, modify, create derivative works of, or publicly transmit Content except as expressly permitted

 

Trademarks

The Elevétion name, logo, and all related names, product and service names, designs, and slogans are trademarks of Elevétion Health LLC or our successors, affiliates, or licensors, whether registered or unregistered. You must not use these marks or designs without our prior written permission. All other trademarks on the Website are the property of their respective owners.

 

Acceptable Use Restrictions

You agree not to use the Website in any way to:

  •       Violate applicable laws and regulations in any jurisdiction
  •       Exploit, harm, or attempt to harm minors by exposing them to inappropriate content or soliciting personal information
  •       Transmit advertising, spam, unsolicited promotional material, or similar solicitations without our prior written consent
  •       Impersonate Elevétion, our employees, or any other person or entity
  •       Use robots, spiders, or automated means to access or monitor the Website without our prior written consent
  •       Introduce viruses, trojan horses, worms, or other malicious code
  •       Use, share, or exploit the Website for commercial, business, or monetized purposes without authorization

 

User Contributions

The Website may include interactive features allowing you to post, submit, or transmit content or materials (collectively, “User Contributions”). All User Contributions must comply with these Terms of Service.

By posting User Contributions, you grant us a non-exclusive, royalty-free, worldwide right to use, reproduce, modify, display, distribute, and disclose such User Contributions for any purpose.

You represent and warrant that you own or control all rights to your User Contributions and that they comply with these Terms of Service. You are solely responsible for your User Contributions, including their legality, accuracy, and appropriateness.

 

Monitoring, Enforcement, and Termination

We may:

  •       Remove or refuse User Contributions for any reason in our sole discretion
  •       Disclose your identity or information to third parties claiming your content violates their rights
  •       Pursue legal action, including referral to law enforcement, for illegal or unauthorized Website use
  •       Terminate or suspend your access for any reason, including breaches of these Terms of Service or inactivity for a period of 12 months

 

Content Standards

User Contributions must comply with all applicable laws and regulations and must not:

  •       Be defamatory, obscene, abusive, offensive, harassing, violent, hateful, or inflammatory
  •       Promote sexually explicit material, violence, or discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age
  •       Infringe any intellectual property or other rights
  •       Deceive, promote illegal activity, or cause annoyance or harm to others
  •       Involve commercial activities without our prior written consent

 

Copyright Infringement

If you believe User Contributions violate your copyright, please send a notice to Elevétion’s Copyright Agent at admin@elevation.com or: Elevétion Copyright Agent, 3200 E Camelback Rd #175, Phoenix, AZ 85018. Please include: identification of the copyrighted work, identification of the infringing material, your contact information, a statement of good faith belief that the use is unauthorized, and a statement under penalty of perjury that the information is accurate and you are authorized to act on behalf of the copyright owner.

 

Reliance on Information Posted

The information presented on or through the Website is made available solely for general information purposes. We do not warrant the accuracy, completeness, timeliness, or usefulness of this information. Any reliance you place on such information is strictly at your own risk.

THE INFORMATION DISPLAYED ON THE WEBSITE IS NOT INTENDED FOR USE IN THE DIAGNOSIS, TREATMENT, CURE, OR PREVENTION OF ANY DISEASE, AND DOES NOT CONSTITUTE MEDICAL ADVICE. Pharmacy Services

Elevétion is not a pharmacy and does not dispense prescription medications. Elevétion does not control or interfere with the professional judgment of licensed healthcare providers or pharmacists. If you participate in telehealth services offered through the Telehealth Platform, you may be referred to a licensed pharmacy that provides prescription fulfillment services. Any prescriptions issued by healthcare providers are fulfilled by independent licensed pharmacies, not by Elevétion.

 

Partner Pharmacies and Laboratories

Our services may include access to prescription fulfillment services offered by the following pharmacies:

  • StrikerRx Pharmacy

  • ReviveRx Compounding Pharmacy

  • Strive Pharmacy

Laboratory services may be provided by:

  • LabCorp

  • Quest Diagnostics

You have the right to have your prescription filled and laboratory work performed by any pharmacy or laboratory of your choosing. However, if you wish to opt out of using our partnered pharmacies, do not complete a purchase through our platform and instead contact us at admin@elevetion.com to discuss alternatives.

Disclaimer of Warranties

The Website, its Content, and any services are provided “as is” and “as available” without warranties of any kind, express or implied, including as to completeness, security, reliability, or availability. To the maximum extent permitted by applicable law, Elevétion disclaims all warranties, including merchantability, non-infringement, and fitness for a particular purpose.

 

Limitation of Liability

To the greatest extent permitted by applicable law, Elevetion LLC, its affiliates and subsidiaries, and its and their respective officers, directors, employees, consultants, representatives, licensors, and agents (together, the “Elevétion”) will not be liable for:

  •       Loss of revenue, profit, opportunity, savings, data, goodwill, or reputation
  •       Indirect, special, incidental, exemplary, punitive, or consequential losses
  •       Device or content damage avoidable by following our advice or due to your failure to meet minimum system requirements

The Elevétion’s aggregate liability under these Terms of Service is limited to the greater of (a) the amount you paid to Elevétion in the prior six months, or (b) ten United States Dollars (USD $10). Nothing in these Terms of Service limits liability that cannot be excluded by applicable law, including for death or personal injury.

 

Indemnification

To the greatest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless each member of the Elevétion from any claims, damages, losses, liabilities, fines, awards, penalties, judgments, costs, or fees (including attorneys’ fees) arising from or related to your violation of these Terms of Service, your violation of law or third-party rights, your negligence or willful misconduct, your User Contributions, or your use or misuse of the Website or Content.

 

Arbitration; No Class Action

Except as otherwise described herein, any dispute, claim, or controversy arising out of or relating to these Terms of Service, including the determination of the scope or applicability of this agreement to arbitrate, shall be referred to and finally determined by arbitration before a sole arbitrator in accordance with JAMS International Arbitration Rules, or submitted to small claims court. The location of any hearing shall be in the State of Utah.

TO THE FULLEST EXTENT PERMITTED UNDER APPLICABLE LAW, YOU AND ELEVÉTION AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

 

Governing Law and Jurisdiction

These Terms of Service and any disputes arising from them are governed by the laws of the State of Utah. Any legal action not subject to arbitration as described above shall be brought in Salt Lake County, Utah. Any claim must be filed within one (1) year of accrual or shall be deemed permanently barred.

 

Miscellaneous

Waiver and Severability

We may transfer our rights under these Terms of Service without affecting your rights. Our failure to enforce any right does not waive it. If any term is deemed unlawful, the remaining terms remain in full effect.

 

Entire Agreement

These Terms of Service and other legal terms posted on the Website constitute the sole and entire agreement between you and Elevétion Health LLC with respect to the Website, superseding all prior and contemporaneous understandings, agreements, representations, and warranties.

 

Language

These Terms of Service are made available in the English language only. If a translation is provided, it is for convenience only, and the English language version shall prevail in any conflict.

 

Survival

Upon termination of these Terms of Service, provisions relating to intellectual property, user contributions, disclaimers, limitation of liability, indemnification, arbitration, and governing law, along with any other accompanying agreements and the Privacy Policy, will survive.

We may contact you via email if you have signed up for our newsletter or other communications, or if we have a commercial relationship with you. You may unsubscribe at any time using the provided link in any communication.

Add- Scope of Services

Our platform connects Users with independent Providers for telehealth services that allow Users to access healthcare remotely through certain means of communication, including quiz or question-based consultations, online chat, and video or phone calls, based on the independent medical judgment of the Providers.

The healthcare services provided through our platform are offered by licensed, independent healthcare professionals authorized to practice medicine in their jurisdictions.
Prescription fulfillment is performed by licensed, independent pharmacies.
Laboratory testing is conducted by licensed, independent laboratories.
Each of these entities operates under their own professional and regulatory obligations. AlgoRx has no control over and does not interfere with their independent professional judgment or services.

By using the platform, you acknowledge and agree that:

  • You are not entering into a provider–patient or pharmacist–patient relationship with AlgoRx.
  • We are not responsible for the outcome of medical care, medication, or laboratory services provided by independent third parties.

Use of Platform

Users must be at least 18 years old to use our platform and must use it for lawful purposes and in accordance with this Agreement. Users may not use our platform to transmit or disseminate any illegal, harmful, offensive, or otherwise objectionable material. Users are solely responsible for ensuring their use of our platform complies with all applicable laws, rules, and regulations.
